Foundation Tier Terms & Conditions
Section 1 – Introduction and Agreement Overview
1.1 About Warrior Wellness Executive Ltd
Warrior Wellness Executive Ltd (“the Organisation”) is the legal provider of the Foundation Tier coaching programme. The programme is delivered through the Warrior Wellness Movement platform and coaching team, which operate as part of the Organisation’s professional delivery network. Warrior Wellness Executive Ltd is responsible for all billing, client contracts, and administration related to the Foundation Tier.
1.2 Purpose of these Terms
These Terms and Conditions form a legally binding agreement between you, referred to as the Client, and Warrior Wellness Executive Ltd, referred to as the Organisation. By enrolling, submitting payment, or accessing any part of the Foundation Tier, you confirm that you have read, understood, and agreed to these Terms.
1.3 Programme Delivery
The Foundation Tier is delivered primarily online through secure platforms including TrueCoach, Skool, and Zoom. Access to the Head Coach and/or Physical Development Coach is provided through the private members area. A live group coaching call is held once each month for all Foundation Tier clients, and the recording is uploaded to the members area for later viewing. The Organisation reserves the right to cancel or reschedule these calls at any time and without prior notice.
1.4 Relationship Between Entities
The Foundation Tier is delivered using the Warrior Wellness Movement website and platform under a licensing agreement between Warrior Wellness Movement Ltd and Warrior Wellness Executive Ltd. Warrior Wellness Movement Ltd owns and operates the digital systems and intellectual property, while Warrior Wellness Executive Ltd provides the client service, coaching delivery, and billing.
1.5 Agreement Start Date
This agreement begins on the date the first payment is successfully processed and continues on a rolling monthly basis unless cancelled in line with the procedures set out in these Terms.
1.6 Governing Law
This agreement is governed by the laws of England and Wales. Any dispute arising from or
connected with this agreement will fall under the exclusive jurisdiction of the courts of England and Wales.
Section 2 – Fees, Payments, and Subscription Terms
2.1 Programme Fees
The monthly fee for the Foundation Tier is £99. A veterans discount of 50 percent is available to eligible clients, reducing the monthly fee to £49. Proof of previous service in the UK Armed Forces may be requested at any time. Failure to provide proof when requested may result in removal from the programme, and no fees will be refunded.
2.2 Billing Cycle and Payment Method
All payments are taken monthly in advance by card or direct debit through a secure third-party provider such as Stripe. The first payment is processed at the time of enrolment, and future payments are taken automatically on the same calendar date each month unless cancelled in line with these Terms. All payments are processed by Warrior Wellness Executive Ltd, which acts as the legal contracting entity for this service. Clients understand that billing and receipts will reference Warrior Wellness Executive Ltd.
2.3 Late or Missed Payments
If a payment is declined or missed, the Organisation will attempt to process it again within seven days. If the payment remains outstanding after this period, access to the Foundation Tier and all associated services may be suspended until the account is brought up to date. A £25 administration fee may be applied to cover the cost of failed payments or manual recovery. Continued failure to pay may result in termination of access without refund and may lead to formal recovery proceedings or legal action.
2.4 Changes to Payment Details
It is the responsibility of the Client to ensure that valid and current payment details are maintained at all times. Any change of bank or card details must be notified by email to admin@warriorwellnessmovement.com at least seven days before the next payment is due.
2.5 Price Changes
The Organisation reserves the right to increase or adjust the Foundation Tier fee. Clients will receive no less than one month’s written notice of any change before it takes effect. If the Client does not wish to continue at the revised rate, they may cancel their membership in accordance with the cancellation procedure outlined in these Terms.
2.6 Non-Transferability
Foundation Tier memberships are personal and cannot be transferred, shared, or reassigned to another individual.
Section 3 – Term, Renewal, and Cancellation
3.1 Minimum Term
The Foundation Tier operates on a rolling monthly basis. There is no fixed contract period beyond the current billing month unless otherwise stated at the time of enrolment.
3.2 Renewal
Membership renews automatically each month on the same calendar date that the initial payment was taken. Renewal continues until the Client cancels their membership in line with these Terms.
3.3 Cancellation by the Client
The Client may cancel their membership by providing 30 days’ written notice by email to admin@warriorwellnessmovement.com. Cancellation becomes effective 30 days after the cancellation request has been received. Access to all coaching material and community areas will remain until this point. No partial or pro-rata refunds will be issued for any remaining days of any billing period.
3.4 Cancellation by the Organisation
The Organisation reserves the right to suspend or terminate membership at any time if:
– Fees remain unpaid after the late payment period set out in Section 2.3
– The Client breaches any part of these Terms
– The Client’s conduct is deemed inappropriate, abusive, or disruptive within the community environment
– The Client fails to provide requested verification for the veterans discount
Continued failure to pay outstanding balances may result in formal recovery proceedings or legal action. In all cases of suspension or termination, no refund will be issued for any remaining portion of the billing period.
3.5 Cooling-Off Period
If the Client enrols online, they are entitled to a statutory 14-day cooling-off period under the UK Consumer Contracts Regulations. The cooling-off period begins the day after the initial payment is made. If the Client chooses to access any part of the programme during this period, they acknowledge that the service has commenced and agree that their right to cancel with a full refund is waived once access has been granted.
3.6 Changes to Service or Schedule
The Organisation reserves the right to make reasonable changes to the format, schedule, or delivery of the Foundation Tier, including group coaching call times and the platforms used. Monthly group coaching calls may be moved or cancelled at any time, and the recording will be made available in the members area for later viewing.
Section 4 – Client Responsibilities, Health and Safety, and Disclaimers
4.1 Client Responsibilities
The Foundation Tier is designed to support and guide clients through structured group coaching and access to the Head Coach and/or Physical Development Coach through the members area. It requires active participation, honesty, and consistency from every client. The Client agrees to:
- Follow the guidance and recommendations provided throughout the programme.
- Engage respectfully within the members area and group coaching sessions.
- Refrain from posting or sharing any content that may be considered offensive, inappropriate, or disrespectful.
- Maintain the confidentiality of other members and respect their privacy at all times.
- Notify the Organisation immediately of any changes in personal details, contact information, or health status that could affect participation.
4.2 Health Declaration
By enrolling in the Foundation Tier, the Client confirms that they are in suitable physical and mental condition to participate in health, fitness, and performance-based activities. The Client is responsible for obtaining medical clearance from a qualified healthcare professional before taking part if there are any pre-existing medical conditions, injuries, or concerns. The Client agrees to disclose any relevant medical history that could influence their ability to participate safely.
4.3 Acceptance of Risk
The Client understands that participation in physical training, nutrition changes, and lifestyle programmes carries inherent risks. By joining the Foundation Tier, the Client accepts full responsibility for their own health, safety, and wellbeing. The Client agrees to use good judgment, follow all instructions provided, and stop any activity that causes pain, discomfort, or concern.
4.4 Health and Safety Compliance
The Client agrees to follow all safety advice and recommendations given during the programme, including exercise technique, nutritional guidance, and general wellbeing practices. Failure to follow the advice of the Organisation or its coaches may increase the risk of injury or poor outcomes and will not be the responsibility of the Organisation.
4.5 Disclaimer of Medical Advice
The Foundation Tier does not provide medical care, diagnosis, or treatment. All coaching, nutritional, and lifestyle advice is for educational purposes only. The Client understands that any recommendations given are not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.
The Client should consult their doctor or another qualified medical professional before making any significant changes to their exercise, diet, or lifestyle habits.
4.6 Limitation of Liability
The Organisation, its employees, and contractors will not be held liable for any injury, illness, loss, or damage arising from participation in the Foundation Tier except in cases of proven negligence or misconduct. The Client understands that results will vary depending on individual effort, health status, and adherence to the programme. No specific outcome, weight loss, or performance result is guaranteed.
Section 5 – Intellectual Property, Confidentiality, and Data Protection
5.1 Ownership of Materials
All content provided within the Foundation Tier, including videos, written materials, graphics, workbooks, guides, exercise programmes, and nutritional resources, remains the exclusive property of Warrior Wellness Executive Ltd. The Client is granted personal access for their own use only. Materials must not be copied, reproduced, shared, sold, or distributed in any form without prior written permission from the Organisation. Any unauthorised use of material may result in immediate removal from the programme and possible legal action.
5.2 Access and Use
Access to digital content, group coaching recordings, and resources is granted for as long as the Client remains an active paying member of the Foundation Tier. Once membership ends, access to all materials, videos, and community areas will be removed.
5.3 Confidentiality
Both the Organisation and the Client agree to treat all personal and sensitive information shared through the Foundation Tier as confidential. This includes information disclosed during group coaching sessions, within the members area, and in private communications. The Client agrees not to share or discuss the personal details, experiences, or progress of other members outside of the private members area.
5.4 Testimonials and Success Stories
The Organisation may request to use anonymised data, feedback, or testimonials to promote the Foundation Tier or other Warrior Wellness programmes. Written consent will be requested before using any personal details, images, or identifiable information.
5.5 Data Protection and Privacy
The Organisation will collect and process personal information in accordance with the UK General Data Protection Regulation (GDPR) and the Data Protection Act 2018. Personal data will only be used for legitimate business purposes, including programme
delivery, communication, billing, and performance tracking. Client information will never be sold or shared with third parties except where required by law or to deliver essential services, such as payment processing through secure third-party providers.
5.6 Data Security
All reasonable steps are taken to protect personal data against loss, misuse, or unauthorised access. However, the Client acknowledges that the transmission of data over the internet carries inherent risks, and the Organisation cannot guarantee absolute security.
5.7 Client Rights
Clients have the right to request access to the personal information held about them, to request correction of inaccuracies, or to request deletion where applicable. Such requests should be made in writing to admin@warriorwellnessmovement.com.
Section 6 – Variation, Termination, and Legal Matters
6.1 Variation of Terms
The Organisation reserves the right to amend, update, or replace these Terms and Conditions at any time. Clients will be notified of any material change by email or through the members area at least 30 days before the change takes effect. Continued payment after this notice period will be treated as acceptance of the revised Terms.
6.2 Termination by the Organisation
The Organisation reserves the right to terminate access to the Foundation Tier immediately if a Client breaches these Terms, behaves in a way deemed inappropriate or damaging to the community, or fails to make payment. Termination will result in immediate removal from all associated platforms and access to programme materials. No refund will be issued for any remaining portion of the billing period.
6.3 Assignment
The Organisation may assign or transfer its rights and obligations under this agreement to another company under the same ownership or management where reasonably necessary to deliver the service. The Client may not assign, transfer, or share their membership or access rights with any other person.
6.4 Force Majeure
The Organisation will not be held liable for failure or delay in delivering the Foundation Tier where circumstances arise beyond its reasonable control. This includes but is not limited to natural disasters, pandemics, government restrictions, power failures, or loss of internet connectivity.
6.5 Entire Agreement
These Terms and Conditions represent the entire agreement between the Client and Warrior Wellness Executive Ltd for participation in the Foundation Tier. They supersede any previous agreements, understandings, or representations, whether written or verbal.
6.6 Severability
If any clause within these Terms is found to be invalid or unenforceable, the remaining clauses shall continue to apply in full force and effect.
6.7 Governing Law and Jurisdiction
This agreement is governed by the laws of England and Wales. Any dispute arising from or related to these Terms shall fall under the exclusive jurisdiction of the courts of England and Wales.
6.8 Dispute Resolution
In the event of a dispute, both parties agree to attempt resolution through good faith discussion or mediation before initiating formal legal proceedings.
